Parking Charges at Sumner Road, Formby get the go ahead

The Decision has now been made by Sefton Council to go ahead with pay & display parking charges at Sumner Road Car park in Formby.
The introduction of a Traffic Regulation Order, the effect of which will be to introduce a charge on Sumner Road car park to come into force by August 11th 2015 if not called in.
The decision for will also be to introduce parking charges controlled by pay & display parking on the Car Park at Burbo Bank in Blundellsands.
However, Sefton Council's proposal to start charging visitors to use Churchtown's Botanic Gardens has been scrapped.
What will it cost and how will it be financed?
(A) Revenue Costs (B) Capital Costs £1000 – legal and administrative costs + £27,000 for machine purchase and installation
As part of the council budget savings to be made for 2015/16 onward and which were accepted by Council at it’s meeting of the 6 th March, to introduce parking charges on Sumner Road car park.
The charges will be set in a future report to the Cabinet but, is likely that they will match the existing charges made at the Waterloo car parks which are:
Up to 30 mins 20p
Up to 2 hours 90p
Up to 4 hours £1.70
Over 4 hours £3.40
Sumner Road Car Park Chargeable by means of pay and display between the hours of 8am and 6pm, 7 days a week.
If the introduction of charges leads to parking being displaced on adjacent streets, then consideration will be given to introducing additional restrictions on any streets affected.

Sefton Council:
Decision - Advertising of Traffic Regulation Orders - Burbo Bank (Hall Road) Car Park, Blundellsands; Sumner Road Car Park, Formby; Botanic Gardens (Verulam Road) Car Park, Southport
Decision:
That, in respect of each location listed in paragraph 2.1 of the report submitted and detailed in each accompanying appendix, the following be approved:-
i. the Traffic Regulation Order, the effect of which will be to introduce parking charges controlled by pay & display parking on the Car Park at Burbo Bank (Hall Road), Blundellsands;
ii. the Traffic Regulation Order, the effect of which will be to introduce parking charges controlled by pay and display parking on the Car Park at Sumner Road, Formby;
iii. the Traffic Regulation Order, the effect of which will be to introduce parking charges controlled by pay and display parking on Sumner Road, Formby south-east side, from a point 121.5 metres north-east of the north-east kerb line of Elbow Lane to a point 146 metres north-east of the north-east kerb line of Elbow Lane
iv. the Manager – Highways Management be authorised to undertake the necessary legal procedures, including those of public consultation and advertising the Council’s intention to implement the Orders;
v. in the event that no objections are received during the consultation process referred to in (iv) above, the Head of Corporate Legal Services be authorised to make the Orders and the Manager – Highways Management be authorised to implement the Orders; and
vi. in the event that objections are received during the consultation process, the matter be referred to the appropriate Area Committee for consideration in accordance with Rule 21 of Chapter 8 (Area Committees) of the Council’s Constitution.
Officers had recommended that a TRO be consulted upon for Verulam Road and the Botanic Gardens (recommendations v and iv of the report submitted). I have decided not to proceed with these recommendations for the following reasons:
• Representations received
• Consequential effects that such proposals would have on the residents in the locality of the Botanic Gardens and Verulam Road
As a result this outcome will need to be referenced in the next budget report to Cabinet
Reason for Decision:
The Council has the power to revoke a Traffic Regulation Order (Part IV of Schedule 9 to the Road Traffic Regulation Act 1984) as well as the power to make a new Traffic Regulation Order (Section 1 of that Act).Authorisation to advertise new Traffic Regulation Orders fall under the remit of Cabinet Member Locality Services.
The proposed Traffic Regulation Orders, have been previously considered by relevant Ward Members
Alternative Options considered:
A Traffic Regulation Orderwas consulted upon for Verulam Road and the Botanic Gardens (recommendations v and iv of the report submitted). And the Cabinet Member has decided not to proceed with these recommendations (See above).

1. There is a clear lack of consistency with regard to the parking charges to be imposed in the borough. You clearly consulted on a TRO for Verulam Road and the Botanic Gardens and decided not to proceed due to Representations received and Consequential effects that such proposals would have on the residents in the locality of the Botanic Gardens and Verulam Road, yet you have failed to offer the same consultation process for Formby residents. This is clearly inconsistent and also discriminates against Formby residents and traders.
2. There has been a clear lack of public consultation with regard to the parking charges and indeed correspondence states that should parking charges be implemented then the widest public consultation would be carried out.
3. There is clear evidence (documented) which shows the impact parking charges have had on local business who had to close their doors when the other car park at Furness Avenue was made into a pay and display and whose takings dropped by up to 50%.
4. Evidence clearly shows where councils are penalising motorists unfairly puts small shops at risk.
5. Parking charges and parking fines should not be used as a fundraising exercise for Councils and should only be implemented in order to keep traffic flowing and ease congestion. This is not the case with Sumner Road and indeed will only increase congestion in the surrounding areas as has already been shown since Furness Avenue has become a pay and display car park. This will have a direct impact on the local residents.
6. Ensuring a free car park for the village ensures a regular footfall to the traders operating from the village. By introducing parking charges evidence shows that people will move to online shopping or out of town shopping where parking is free in order not to be penalised for shopping locally.
7. It is showing discrimination against small traders operating in villages and towns whose patrons have to pay for parking and the larger national companies benefit from free car parking facilities in out of town shopping areas. This is clear discrimination.
8. As a council you actively promote shop local yet you now want to penalise people who do, again this is discrimination.
9. You state that The proposed Traffic Regulation Orders, have been previously considered by relevant Ward Members and I personally have objected as a Ward Member when they were first proposed and have never agreed to such regulations."
